RCON Hub End User Licence Agreement

This End User Licence Agreement ("Agreement") is between you (the person or organisation installing or using the software) and ClanStop ("ClanStop", "we", "us"). It covers RCON Hub, the game tools you add to it (for example the tools for Rust, 7 Days to Die, Valheim, Palworld, Grounded 2, Project Zomboid, DayZ, ARK: Survival Ascended, ARK: Survival Evolved and WARDOGS), their updates, and the documentation that comes with them (together, the "Software").

By installing, copying or using the Software you agree to this Agreement. If you do not agree, do not install or use the Software.

1. Licence

1.1 ClanStop gives you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software to manage game servers that you own, rent or are authorised to administer, for as long as this Agreement lasts.

1.2 You may let other people (your admins and moderators) use the Software through accounts you create in your RCON Hub. You are responsible for what they do with it.

1.3 The Software is licensed, not sold. ClanStop and its licensors keep all rights, title and interest in it, including all copies, updates and intellectual property rights. Any right not expressly given to you here is reserved.

2. What you may not do

Unless the law allows it despite this restriction, you may not:

copy the Software except as needed to install and use it, and to make a backup;
reverse engineer, decompile, disassemble or otherwise try to obtain the source code of the Software, or get around any technical protection in it (including the signature checks on its list of games and updates);
modify, translate or make derivative works of the Software;
rent, lease, lend, sell, sublicense, distribute or host the Software for third parties as a service;
remove or change any copyright, trademark or other notice in the Software;
use the Software to break the law, a game's terms of service, or another person's rights, or to manage servers you are not authorised to administer;
send ClanStop false, forged or misleading data (for example fake global-ban reports).

3. Third-party components

The Software includes open-source components that are licensed under their own terms. Those terms apply to those components, and nothing in this Agreement limits your rights under them. They are listed in THIRD_PARTY_NOTICES.md, installed next to RCON Hub.exe.

The games and game servers you manage, and the services you connect the Software to (such as your server host, Steam, Discord, Nitrado or a tunnel provider), belong to their own owners and are governed by their own terms. ClanStop is not responsible for them.

4. ClanStop services and your data

Some features connect to services that ClanStop runs, such as the list of games and updates, ClanStop sharing, public server stats and ClanStop global bans (Fair-Fight). Sharing with ClanStop is off until a server owner turns it on for a server. How ClanStop handles that data is described in the RCON Hub Privacy Notice, and how global bans work is described in the ClanStop Global Ban Terms. ClanStop may change, suspend or end these services at any time.

5. Updates

The Software can check for and install updates to itself and to its game tools. Updates are covered by this Agreement unless they come with different terms. ClanStop does not have to provide updates, support or any particular feature.

6. Preview features

Some game tools and features are marked Preview. They have only been tested against stand-in servers and may not work correctly with a real server. Use them at your own risk and keep backups.

7. No warranty

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. CLANSTOP DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED, THAT IT WILL NOT LOSE DATA (INCLUDING GAME WORLDS, SAVES OR BACKUPS), OR THAT IT WILL DETECT OR STOP EVERY CHEATER. YOU ARE RESPONSIBLE FOR KEEPING YOUR OWN BACKUPS.

8. Limitation of liability

8.1 TO THE FULLEST EXTENT PERMITTED BY LAW, CLANSTOP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GAME PROGRESS OR GOODWILL, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.2 TO THE FULLEST EXTENT PERMITTED BY LAW, CLANSTOP'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID CLANSTOP FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR [amount].

8.3 Nothing in this Agreement limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

9. Termination

9.1 This Agreement lasts until it ends. You may end it at any time by uninstalling the Software and deleting all copies.

9.2 ClanStop may end this Agreement, or suspend your access to ClanStop services, if you break it. ClanStop may also end it for everyone by giving notice (for example on https://clanstop.com/rconhub/).

9.3 When this Agreement ends you must stop using the Software and delete all copies. Sections 2, 3, 7, 8, 10 and 11 continue to apply after it ends.

10. Governing law

This Agreement is governed by the laws of [jurisdiction], without regard to its conflict-of-laws rules. The courts of [jurisdiction] have exclusive jurisdiction over any dispute arising out of or related to it, except where the law of the country you live in gives you the right to bring a claim locally.

11. General

Changes. ClanStop may update this Agreement. The new version applies from the next update of the Software or when it is published on https://clanstop.com/rconhub/. If you do not agree to it, stop using the Software.
Entire agreement. This Agreement, the Privacy Notice and the Global Ban Terms are the whole agreement between you and ClanStop about the Software.
Severability. If any part of this Agreement is found unenforceable, the rest stays in effect.
No waiver. Not enforcing a right is not a waiver of it.
Assignment. You may not transfer this Agreement. ClanStop may transfer it to a successor.
Export. You must follow the export and sanctions laws that apply to you.
