ClanStop Terms of Service

Welcome to ClanStop! These Terms of Service ("Terms") govern your access to and use of clanstop.com, the ClanStop Discord bot, and any related applications or services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree with any part of these Terms, you may not use the Services.
1. Age Requirements
To register for and use the Services, you must be at least 13 years old, or the higher minimum age required by the laws of your country, whichever is greater. If you are under the age of majority where you live, you must have permission from a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
The responsibility for ensuring a user meets the age requirement falls on the user and on the user’s parents or legal guardians. By allowing a minor to use the Services, parents and guardians assume full responsibility for that minor’s use, including all legal and financial liability. If we learn that an account belongs to a child under 13 (or under the minimum age in their jurisdiction), we will terminate that account and delete the associated personal information as described in the Privacy Policy.
2. Your Account
You are responsible for the information you provide when creating an account, for keeping that information current, and for safeguarding your password. You are responsible for activity that occurs under your account. If you believe your account has been accessed without your permission, you must notify us promptly at [email protected].
You may not create an account using another person’s identity, impersonate another person or entity, or transfer your account to anyone else without our written consent. You may not use the Services if you have previously been banned.
3. Privacy and Data
How we collect, use, share, and protect your information is described in our Privacy Policy. By using the Services you acknowledge that you have read the Privacy Policy. We do not sell your personal information, and we do not share it with third parties for their own advertising.
4. Cookies
The Services use a first-party session cookie to keep you signed in and a small amount of local browser storage to remember preferences. We do not use advertising cookies or third-party tracking pixels. See the Cookies section of the Privacy Policy for details. You can block cookies in your browser settings, but if you do, you will not be able to stay signed in.
5. Acceptable Use and Prohibited Conduct
You agree that you will not, and will not attempt to:
- Post, upload, link to, or transmit any content that is illegal, that sexually exploits or endangers minors (including child sexual abuse material), or that solicits or facilitates such content. We report apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
- Harass, bully, threaten, stalk, intimidate, or incite violence against any person or group.
- Post hateful content directed at people on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or veteran status.
- Dox or publish another person’s private information (home address, government ID, private contact information, etc.) without their consent.
- Post or distribute spam, scams, phishing links, malware, or other deceptive content.
- Promote, sell, or distribute cheats, hacks, automation tools, or modifications that violate any game publisher’s terms or that enable cheating in competitions hosted through the Services.
- Infringe anyone’s intellectual property, privacy, or publicity rights, including by uploading content you do not have the right to share. See Section 10 for the copyright complaint procedure.
- Misrepresent yourself, your affiliation with any person or entity, or the source of any content.
- Use the Services for commercial activity not authorized by us, including unauthorized advertising, recruiting for unrelated platforms, or selling accounts, clans, or in-game items.
- Interfere with or disrupt the Services, including by scraping, automated access not permitted by published APIs, denial-of-service activity, probing for vulnerabilities, or circumventing rate limits and access controls.
- Reverse engineer, decompile, or otherwise attempt to extract source code from the Services except to the extent that applicable law expressly permits.
- Evade enforcement actions, including by creating new accounts after being suspended or banned.
Violation of any of the above may result in content removal, account suspension or termination, loss of clan ownership, forfeiture of tournament entries, and where appropriate, referral to law enforcement.
6. Third-Party Links and Advertising
The Services may include links to websites, applications, and services operated by third parties, including those provided through advertising or through integrations with platforms such as Discord, Steam, Twitch, YouTube, Kick, TikTok, Streamable, Medal.tv, and Spotify. ClanStop has no control over those third parties. We are not responsible for their content, practices, or any damages or losses arising from your use of them. Any data you provide to a third party is governed by that third party’s terms and privacy policy.
If the Services display advertising, you acknowledge that we do not always control which specific ads are shown, and we are not responsible for the content of any advertisement. Your interactions with any advertiser are solely between you and the advertiser.
7. Official Giveaways
From time to time, ClanStop may host official giveaways. By participating, you agree to follow the specific rules posted for that giveaway. Giveaways may be canceled at any time and for any reason without liability, including due to:
- Cheating or fraudulent activity.
- Software or technical errors.
- User errors.
Unless explicitly stated otherwise in the official giveaway rules, you acknowledge that the prizes in our giveaways have a maximum cash value of $0.01 USD and cannot be exchanged for money or any other form of compensation.
8. Tournaments and Competitive Play
The Services may host or facilitate tournaments organized by ClanStop or by clans and users ("Organizers"). The following terms apply:
- Tournament rules. Each tournament may publish its own rules covering eligibility, format, schedule, conduct, prize structure, and dispute resolution. Those rules apply in addition to these Terms. Where they conflict on a matter specific to that tournament, the published tournament rules control.
- Eligibility. You must comply with the eligibility rules of the tournament you enter, including any age, region, or game-publisher restrictions.
- Fair play. Cheating, exploiting bugs, smurfing, account sharing, collusion, match fixing, and any other form of competitive integrity violation are prohibited and may result in disqualification, forfeiture of prizes, and account action.
- Organizer responsibility. Organizers other than ClanStop are responsible for running their tournaments, awarding any prizes they offer, and complying with applicable law (including any gambling, lottery, or sweepstakes laws that may apply). ClanStop is not a party to those tournaments and is not responsible for prize fulfillment by third-party Organizers.
- ClanStop-run tournaments. For tournaments officially run by ClanStop, we may modify, suspend, or cancel a tournament for any reason, including technical issues, low participation, or suspected misconduct. Refunds, if any, will be as stated in the tournament’s published rules.
9. User-Generated Content
You retain ownership of the content you create and submit through the Services ("User Content"). However, by submitting User Content, you grant ClanStop a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for example, to resize an image), create derivative works (for example, to generate a preview), publish, transmit, and display the User Content for the purpose of operating, providing, and promoting the Services. This license lasts only as long as you keep the User Content on the Services, except that (a) we may retain copies for backup, legal, and security purposes for a reasonable period after removal, and (b) others may have already shared or quoted your User Content, and you cannot revoke those copies.
You represent and warrant that (i) you own or have the necessary rights in the User Content you submit; (ii) your User Content does not violate these Terms; and (iii) sharing your User Content through the Services does not violate any third party’s rights or any applicable law.
We may, at our discretion, remove or restrict User Content that violates these Terms or that we believe in good faith may cause harm, without prior notice. We are not obligated to monitor User Content, and we have no liability for User Content posted by users.
10. Copyright Complaints (DMCA)
If you believe content on the Services infringes your copyright, you may send a notice of claimed infringement under the U.S. Digital Millennium Copyright Act ("DMCA") to our designated agent. Your notice must include:
- A physical or electronic signature of the copyright owner or person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- A URL or other specific identification of the material claimed to be infringing.
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-notice. If you believe your content was removed in error, you may send a counter-notice to the same address containing the elements required by 17 U.S.C. § 512(g)(3).
Repeat infringers. We will, in appropriate circumstances, terminate the accounts of users we determine to be repeat infringers.
11. Moderation and Enforcement
We may, at our sole discretion and with or without notice:
- Remove, edit, blur, or restrict access to any User Content that we believe violates these Terms or applicable law.
- Suspend, restrict, ban, or delete any account, clan, or other user-created group for any reason consistent with these Terms.
- Use automated tools to assist with moderation. Content flagged by these tools may be blurred or hidden from users based on their personal safety settings.
- Display, to other users, that an account is suspended or banned, and the reason for that action.
- Refuse service to anyone for any lawful reason.
We are not required to provide notice or reasons for any moderation action, though we may. You understand and agree that we are not responsible for any losses or damages arising from these actions, except as required by law.
12. Use of Content on Other Platforms
By using the Services, you agree that we may display, share, or otherwise use content from the Services on related ClanStop applications and platforms. This includes desktop applications, the ClanStop Discord bot, ClanStop-operated Discord servers, and similar properties operated by ClanStop or its affiliates, in each case consistent with the visibility settings of the content (we will not, for example, expose private content publicly).
13. Legal Compliance and Cooperation
ClanStop is committed to complying with applicable laws. You acknowledge that we may access, preserve, and disclose your data, including any User Content, if required to do so by law or in the good-faith belief that such action is necessary to: (a) comply with a legal obligation, such as a subpoena, court order, or search warrant; (b) enforce these Terms; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property, or personal safety of ClanStop, our users, or the public.
14. Reporting to Authorities
We reserve the right to report any user or activity to law enforcement, NCMEC, or other government officials if we believe, in our sole discretion, that doing so is in the best interest of that user, other users, or the public. This includes situations involving potential harm, threats to safety, child exploitation, or other illegal activity. We are not responsible for the outcomes of any such report.
15. Termination
You may stop using the Services at any time. You may request deletion of your account by contacting [email protected]; if in-product account deletion is enabled, you may also use that flow in your account settings. After deletion, your public content may remain visible in a deidentified form (for example, attributed to "[Deleted User]") as described in the Privacy Policy.
We may suspend or terminate your access to the Services, in whole or in part, at any time, with or without notice, if we believe you have violated these Terms or if continued access could cause harm to ClanStop, our users, or third parties. Sections of these Terms that by their nature should survive termination (including content licenses for already-shared User Content, disclaimers, limitations of liability, indemnification, and dispute-resolution terms) will survive.
16. Paid Features and Premium Subscriptions
Some current or future features of the Services may be offered on a paid or subscription basis ("Paid Features"). When you purchase a Paid Feature, additional terms presented at the point of purchase (price, billing period, renewal terms, refund policy, taxes, and any feature-specific rules) will apply along with these Terms. Unless required by law or expressly stated, all fees are non-refundable. We may change the price, structure, or availability of Paid Features going forward; changes will not apply to a paid period you have already paid for.
17. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless ClanStop and its parent companies, subsidiaries, affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with (a) your access to or use of the Services, (b) your violation of these Terms, (c) your violation of any rights of another, or (d) your User Content.
18. Disclaimer of Warranties
The Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, ClanStop and its parent and sister companies disclaim all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any content (including User Content from other users) will be accurate or reliable.
19. Limitation of Liability
To the maximum extent permitted by law, in no event will ClanStop or its parent and sister companies be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, use, goodwill, or other intangible losses, arising out of or related to your access to or use of (or inability to access or use) the Services, the conduct or content of any third party on the Services, or any unauthorized access, use, or alteration of your content, even if ClanStop has been advised of the possibility of such damages. Our aggregate liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you have paid to ClanStop in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and ClanStop agree to try in good faith to resolve any dispute informally before filing a formal claim. To start informal dispute resolution, send a written notice describing the dispute to [email protected]. If we cannot resolve the dispute within 60 days, either party may bring a claim. Unless prohibited by applicable law, any claim arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in [COUNTY], [STATE], and you consent to personal jurisdiction in those courts.
Class action waiver. To the extent permitted by law, you and ClanStop agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
21. Changes to These Terms
We may modify these Terms at any time. When we do, we will post the revised Terms on this page and update the "Effective Date" at the top. If the changes are material, we will provide additional notice (for example, in-app or by email). Your continued use of the Services after a change takes effect constitutes your acceptance of the revised Terms.
22. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and ClanStop regarding the Services and supersede any prior agreements on the same subject.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.
- Headings. Section headings are for convenience only and do not affect interpretation.
